1. Acceptance of Terms

By accessing and using Atty’s AI-powered answering service (“Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms and Conditions, please do not use our Service.

2. Description of Service

Atty provides an AI-powered telephone answering and client intake service designed specifically for law firms and legal professionals. Our Service includes:

  • 24/7 automated call answering
  • Client intake and information gathering
  • Appointment scheduling
  • Call transcription and documentation
  • Integration with practice management systems

3. Call Recording & Consent

All telephone calls handled by Atty’s AI-powered answering service are recorded and transcribed for quality assurance, service improvement, and compliance purposes. By using the Service, you acknowledge and agree to the following:

  • Recording Notice: A verbal notice is provided at the beginning of each call informing the caller that the call may be recorded and transcribed
  • Consent: Continued participation in the call after the recording notice constitutes consent to the recording and transcription
  • Retention: Call recordings are retained for up to 90 days for quality assurance purposes and up to 2 years for compliance and legal requirements, unless a different retention period is configured in your account settings
  • Access: You may access your call recordings and transcriptions through your Atty dashboard

Two-Party Consent States

Certain states require all parties to a call to consent to recording. These states include California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington. Atty’s recording notice is designed to comply with these requirements. You are responsible for ensuring your use of call recordings complies with all applicable federal, state, and local laws in your jurisdiction.

4. No Legal Advice

Atty is a technology service provider and does not provide legal advice or legal services. Our AI system is designed to gather information and facilitate communication between law firms and potential clients. The Service:

  • Does not create an attorney-client relationship between callers and Atty
  • Should not be relied upon for legal advice or legal opinions
  • Is not a substitute for consultation with a licensed attorney

5. User Obligations

As a subscriber to our Service, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations
  • Use the Service only for lawful purposes
  • Not attempt to interfere with or disrupt the Service
  • Ensure your use complies with professional responsibility rules in your jurisdiction

6. SMS Communications

By providing your mobile phone number and opting in through a consent checkbox, web form, or other electronic method, you consent to receive automated SMS/text messages from Atty. Messages may include:

  • Urgent call alerts and missed call notifications
  • Emergency and time-sensitive caller notifications
  • Appointment confirmations and reminders
  • Client intake follow-ups
  • Service notifications and updates
  • Account and billing alerts

Opting Out

You may opt out of receiving SMS messages at any time by replying STOP to any message. Opt-out requests are processed immediately and typically take effect within 10 minutes. After opting out, you will receive a one-time confirmation message and no further texts will be sent unless you re-subscribe.

Message Frequency and Rates

Message frequency varies based on your account activity and preferences. Message and data rates may apply depending on your mobile carrier and plan. Atty is not responsible for any charges imposed by your carrier.

7. TCPA Compliance

In accordance with the Telephone Consumer Protection Act (TCPA):

  • Atty will not send autodialed or prerecorded marketing messages to your mobile phone without your express written consent
  • Atty will not contact numbers listed on the National Do Not Call Registry for marketing purposes
  • Consent to receive SMS messages is not required as a condition of purchasing any goods or services from Atty
  • Atty maintains records of all consent transactions, including the date, time, and method of consent

8. Privacy and Data Protection

We take data privacy seriously. All information collected through our Service is handled in accordance with our Privacy Policy. We implement industry-standard security measures to protect client data, including encryption and secure data storage. You retain ownership of all client data collected through the Service.

9. Confidentiality

We understand the sensitive nature of legal communications. While we implement security measures to protect information, you acknowledge that you are responsible for ensuring that your use of the Service complies with attorney-client privilege and confidentiality requirements in your jurisdiction.

10. Payment Terms

10.1 Subscription Fees

Subscription fees are billed in advance on a monthly basis at the rate displayed for your selected plan at the time of enrollment. You agree to pay all fees associated with your subscription and provide current, accurate billing information.

10.2 Usage-Based Charges (Overages)

Each subscription plan includes a specified number of AI receptionist minutes per billing cycle. If your usage exceeds your plan’s included minutes (“Overage”), additional minutes are billed at the per-minute overage rate displayed on your plan at the time of enrollment. Overage charges are calculated at the end of each billing cycle and automatically charged to your payment method on file.

10.3 How Minutes Are Calculated

Minutes are measured from the time the AI receptionist answers a call to the time the call ends, rounded up to the nearest minute. Your real-time usage is visible at any time through your account dashboard at portal.atty.ai.

10.4 Payment Authorization

By subscribing to the Service, you authorize Atty to charge your payment method on file for: (a) your recurring monthly subscription fee, and (b) any overage charges incurred during each billing cycle. You acknowledge that the total amount charged may vary from month to month based on your usage.

10.5 Usage Notifications

We will send you email notifications when you reach approximately 75%, 90%, and 100% of your plan’s included minutes during a billing cycle. These notifications are provided as a courtesy. Failure to receive a notification does not relieve you of responsibility for overage charges.

10.6 Spending Caps

You may set a monthly overage spending cap through your account dashboard. When your spending cap is reached, incoming calls will be routed to voicemail until the next billing cycle begins or you adjust your cap. By default, no spending cap is applied, and all calls will be answered by the AI receptionist regardless of usage.

10.7 Billing Disputes

If you believe a charge is incorrect, you must notify us within 30 days of the charge by contacting support@atty.ai. We will review your dispute and provide a resolution within 10 business days. Detailed usage logs are available in your account dashboard for your review at any time.

10.8 Refunds

Subscription fees and overage charges are non-refundable except as required by applicable law or as otherwise specified in these Terms.

11. Free Trial

New subscribers may be eligible for a 14-day free trial. During the trial period, you have full access to all features of your selected plan, including the plan’s included minutes.

At the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method on file will be charged the applicable subscription fee, unless you cancel before the trial expires.

You may cancel your trial at any time through your account dashboard at portal.atty.ai or by contacting support@atty.ai. If you cancel during the trial period, you will not be charged.

12. Auto-Renewal

Your subscription will automatically renew at the end of each billing cycle at the then-current rate for your plan. We will send a reminder email at least 7 days before each renewal.

You may cancel auto-renewal at any time through your account dashboard or by contacting support@atty.ai. Cancellation takes effect at the end of the current billing cycle — you will retain access to the Service until then.

Any outstanding overage charges incurred before cancellation will be billed to your payment method on file at the end of the billing cycle in which you cancel.

13. Service Availability

While we strive to provide uninterrupted service, we do not guarantee that the Service will be available at all times. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Limitation of Liability

To the maximum extent permitted by law, Atty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Atty and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the Service or violation of these Terms.

16. Intellectual Property

All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, and AI models, are owned by Atty and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

17. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account dashboard at portal.atty.ai or by contacting support@atty.ai.

Upon cancellation, you will retain access to the Service until the end of your current billing cycle. Any overage charges incurred prior to the effective cancellation date will be billed to your payment method on file.

We reserve the right to suspend or terminate your access to the Service for violation of these Terms or for any other reason at our discretion. In the event of termination by Atty without cause, you will receive a pro-rated refund of any prepaid subscription fees for the unused portion of your billing cycle.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
